Shaping Environmental Law: Two CJEU's recent Judgments analyzed by Ariti Tsoukala

 In her latest analysis article in “Environment and Law” magazine (NOMIKI BIBLIOTHIKI ), our Associate, Ariti Tsoukala, brings to light two noteworthy CJEU judgements. In these two cases, the Court has made significant rulings shaping the landscape of environmental and administrative law:
 
-In Case C-575/21, WertInvest Hotelbetriebs GmbH, the Court assessed Austria's decision to deny planning permission for a major building complex in central Vienna. The project's location on a UNESCO World Heritage site raised concerns. The CJEU's decision addresses key issues regarding prior environmental impact assessments.
 
-Case C-444/21, Commission v. Ireland, highlights Ireland's failure to comply with the Habitats Directive 92/43. The Court examined Ireland's delays in designating special conservation areas and providing detailed conservation objectives and measures.
 
These rulings emphasize the importance of environmental protection and legal compliance at national and EU levels.
